Before I returned the unit for exchange I found a worked around: keep the audio player playing repeatedly a blank mp3 file in the background. N770 still would switch off the screen when you close the lid but wouldn't sleep completely.

Thank you guys for your advise, I don't know if I send it for repair or send it back to Expansys... will decide this eveniing
