Those are not that hard to find either. Maybe not everybody has one already, but they are easily obtainable. This doesn't seem like the usual crap Apple pulls with their proprietary connectors etc to force you to pay through the nose for a cable that should cost a few pennies.

You're missing the point here again , its not only about screwdriver but about screws itself , those tamper resistant screws usually break when you unscrew them , so basically this means you should buy a special 5 star screwdriver and a set of those screws if you want to open iPhone 4

Nope, these are the "tamper resistant" (defined as "Drivers only available to OEM's and authorized service personnel" - yeah, right) ones. Note the post in the centre and compare with the picture in the original article, very different things.

Got a reference for that?

Of course, if you don't like them you're free to replace them with Phillips screws or whatever else you fancy.

Torx screws don't cam-out when you apply too much force [Source: Wikipedia; Reason: Industry finds caming-out shortening life of screwdrivers]. Most likely, torx screws break when you apply too much force.

That would be when screwing them in though, not when removing them.

From my paltry understanding of the Law (ps. feel free to correct me):

This is illegal because he's using the Apple logo trademark. He'll likely get a cease and desist letter from Apple's legal department as soon as they find out, leaving him with plenty of inventory (if indeed he's not reselling the cases).

If we were to remove the Apple logo, they would be hard pressed to do anything about it. Of course, they could still sue, and he would have to defend against a multi-billion dollar Juggernaut.
