My 8 years old Motorola Xoom behaves the same way, sometimes detecting a "touch" from a few mm away. This "3D" gimmick looks to me like, "Bugger our digitizer is too sensitive and we do not know how to fix it. I know, let's market it like it was intentional all along!"
